Marine Captain to be Charged in Haditha Killings

A lawyer for a U.S. Marine Corps captain says his client, Lucas McConnell, will be charged Thursday in connection with the Haditha killings of 24 civilians in Iraqi.

The charge most likely will be dereliction of duty.

Another marine may also be charged:

...a second officer, with a Marine intelligence unit that initially investigated and photographed the killings, might also be charged.

We reported on December 5 that five marines would likely be charged.

In an interview with the Washington Post, President Bush admits for the first time we are not winning the war in Iraq.

So, is he ready to retreat? Of course not. He wants to add more troops to the failed extravaganza.

In another turnaround, Bush said he has ordered Defense Secretary Robert M. Gates to develop a plan to increase the troop strength of the Army and Marine Corps, heeding warnings from the Pentagon and Capitol Hill that multiple deployments in Iraq and Afghanistan are stretching the armed forces toward the breaking point. "

He seems to be willing to consider every option but the right one: Bring the troops home.

No Indictments for Civilian Contractors Who Abused Iraq Detainees

The New York Times published an article Monday on the broken military policing system in Iraq. Despite more than 20 reported cases of abuse, not one contractor has been indicted.

Today the Times has a damning editorial on the the broken system, Only the Jailers Are Safe.

Donald Vance, a 29-year-old Navy veteran from Chicago, was a whistle-blower who prompted the raid by tipping off the F.B.I. to suspicious activity at the company where he worked, including possible weapons trafficking. He was arrested and held for 97 days — shackled and blindfolded, prevented from sleeping by blaring music and round-the-clock lights. In other words, he was subjected to the same mistreatment that thousands of non-Americans have been subjected to since the 2003 invasion.

Even after the military learned who Mr. Vance was, they continued to hold him in these abusive conditions for weeks more. He was not allowed to defend himself at the Potemkin hearing held to justify his detention. And that was special treatment. As an American citizen, he was at least allowed to attend his hearing. An Iraqi, or an Afghani, or any other foreigner, would have been barred from the room.

Who's at fault? Not just a few bad apples. The Times says:

Administration officials said that prosecutors were hobbled by a lack of evidence and witnesses, or that the military’s cases were simply shoddy. This sounds like another excuse from an administration that has papered over prisoner abuse and denied there is any connection between Mr. Bush’s decision to flout the Geneva Conventions and the repeated cases of abuse and torture. We hope the new Congress will be more aggressive on this issue than the last one, which was more bent on preserving the Republican majority than preserving American values and rights. The lawless nature of Mr. Bush’s war on terror has already cost the nation dearly in terms of global prestige, while increasing the risks facing every American serving in the military.

Our ever-defiant president intends to continue wielding unbounded and unchecked executive power, regardless of what a court tells him about the law, and if you don't like it, you're naive.

"I would say that those who herald this decision simply do not understand the nature of the world in which we live," Mr. Bush said in a question-answer session at Camp David, Md.

"This decision" refers to Judge Taylor's declaration that the NSA wiretapping program is unconstititutional (discussed here and here at TalkLeft). "Those who herald the decision" understand the Constitution and the obligation of the president to obey the law. It's really pretty simple.

The president resorted to his tired argument, "if Al Qaeda is calling into the United States, we want to know why they're calling." So do we. That's why we want the president to hasten to a FISA court and get a warrant that will help him intercept suspicious calls. His stubborn insistence that he don't need no stinkin' warrant has nothing to do with national security and everything to do with an unprecedented assertion of executive domination over the other -- supposedly coequal -- branches of government.

Federal Judge Rules Warrantless Wiretaps Unconstitutional

U.S. District Judge Anna Diggs Taylor has struck down the NSA program in a suit brought by the ACLU.

DETROIT - A federal judge ruled Thursday that the government's warrantless wiretapping program is unconstitutional and ordered an immediate halt to it.
U.S. District Judge Anna Diggs Taylor in Detroit became the first judge to strike down the National Security Agency's program, which she says violates the rights to free speech and privacy.

Keep an eye on Unclaimed Territory, where Greenwald is following closely.

Some background on the case is here, where I previously noted that it seemed the judge was, at the very least, intent on scrutinizing, rather than blindly accepting, the Bush administration's claims. This also means, presumably, that this is now the second consecutive federal court to reject the Bush administration's invocation of the "state secrets" doctrine as a means of avoiding judicial review.
This is huge news, obviously. More to follow.

I have no clue as to whether the information provided is accurate or not, but I’ve gotten so many tips and e-mails about it today that I’m sure the issue isn’t going to just disappear. Here’s the news release in question:

This Monday, George W. Bush will address the nation, calling for a constitional amendment to ban gay marriage. If he does not admit that he’s a gay American (or perhaps bisexual), this speech will be as false as all his other public statements.

Too bad I won’t be doing the rebuttal. In 1984 I watched George W. Bush enthusiastically and expertly perform a homosexual act on another man, one Victor Ashe.

Ashe is the current U.S. ambassador to Poland; and he too should come out, like former New Jersey Gov. James McGreevy, and admit to being a gay American.

Other homo-erotic acts were also performed by then-private citizen George W. Bush. I know this because I performed one of them on him myself.

Bush’s sex life should, of course, be no one’s business but his own; however, his craven effort to reverse his slide in the opinion polls by using the “Defense of Marriage Act” to divide Americans must be exposed as the act of a desperate closet case.

Before impugning the humanity of gays who seek to marry–just as he was free to marry–Bush should come clean with the American people and admit his own past sexual behavior. He should admit that he violated his own marriage vows by having a furtive homosexual affair with a longtime family friend.

I had planned to run for governor of Nevada without going into any of this, but the president’s hypocrisy compels me to go public with the story now, before he tries to do more harm to millions of his fellow-citizens.

Ann Coulter is releasing her new book "Godless" on 6-6-06, presumably to honor her Dad's big day.

In a true spirit of piety, the Bony One dressed like a whore when she rattled her way onto the Today Show to promote her latest keyboard clobberings. (Question of usage: Should I have written "as a whore"?) Here's what Ann, friend to Jesus, has to say in her book about the 9/11 widows:

"These broads are millionaires, lionized on TV and in articles about them, reveling in their status as celebrities and stalked by griefparrazies. I have never seen people enjoying their husband's death so much."

The obscene claim that these women enjoyed seeing their husbands burn and plummet is, I believe, actionable. Will a Democratic lawyer step forward to take on this monster?

On Today, Coulter clarified. I haven't the transcript to hand, but, if a paraphrase may serve, she said that the widows used the tragedy to push their political agenda, while the rest of us are not allowed to do so. Ah yes. We have all heard so very much from those widows. Why, just turn on your AM radio or cable news, and you will hear nothing but 9/11 widows, while Bush supporters have been censored from the dialogue entirely.

As always, the conservatives adopt the "false underdog" position. The oppressor loves to pretend to be the aggrieved party.

Did you catch "V for Vendetta" yet? It's the best film I've seen in years. One could not help thinking of Coulter during the opening scene, in which a fulminating TV hate-monger, in service to a fascist state, uses the term "Godlessness" in a supremely Coulterian fashion.

And this Harlot of Hate claims to represent the Prince of Peace...!

Tonight's Item that Everyone Else Has Already Linked to, and Certainly Ought to if They Haven't, comes from Prof. Juan Cole, who, in the course of rolling a drunk, delivers the most rousing, impassioned, invigorating call to action we expect to read in 2006:

What is really going on here is an old trick of the warmongers. Which is that you equate hurtful statements of your enemy with an actual military threat, and make a weak and vulnerable enemy look like a strong, menacing foe. Then no one can complain when you pounce on the enemy and reduce his country to flames and rubble.

It is obvious that powerful political forces in Washington are fishing for a pretext to launch a war on Iran, and that they are just delighted to have Ahmadinejad as cartoon villain and pretext. But they had a moderate, reforming president in Mohammad Khatami for 8 years, and just blew off all his overtures to the West. Iranians organized big candle-light vigils for America after September 11, in sympathy!

Washington never gave the reform movement the slightest encouragement, perhaps in hopes that the Iranians would be forced to turn right again and form a proper object of US hatred. If so, they got their wish last summer, when Ahmadinejad used the same dirty techniques to get elected as had George W. Bush.

All the warmongers in Washington, including Hitchens, if he falls into that camp, should get this through their heads. Americans are not fighting any more wars in the Middle East against toothless third rate powers. So sit down and shut up.

One, two, three, four! We don't want your stinking war!

We are not going to see any more US troops come home in body bags at Dover for the sake of some Cheney affiliate grabbing the petroleum in Iran's Ahvaz fields.

We are not going to have another 15,000 wounded vets flood onto our streets with spine damage and brain damage.

We are not going to put Yazd behind barbed wire to liberate it, as a millenarian Christian general did to Habbaniyah in Iraq.

WASHINGTON -- President Bush has quietly claimed the authority to disobey more than 750 laws enacted since he took office, asserting that he has the power to set aside any statute passed by Congress when it conflicts with his interpretation of the Constitution.
Among the laws Bush said he can ignore are military rules and regulations, affirmative-action provisions, requirements that Congress be told about immigration services problems, ''whistle-blower" protections for nuclear regulatory officials, and safeguards against political interference in federally funded research.
Legal scholars say the scope and aggression of Bush's assertions that he can bypass laws represent a concerted effort to expand his power at the expense of Congress, upsetting the balance between the branches of government. The Constitution is clear in assigning to Congress the power to write the laws and to the president a duty ''to take care that the laws be faithfully executed." Bush, however, has repeatedly declared that he does not need to ''execute" a law he believes is unconstitutional.
